These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Migosys ("we", "us", or "our"), concerning your access to and use of the migosys.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto. By accessing the site, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the site and you must discontinue use immediately.

Unless otherwise indicated, the website is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. Migosys provides custom digital agency services, including Web Development, Salesforce CRM Designing, HubSpot API Integration, CRM Migration, and Website Migration. Our services are provided under custom statement of work (SOW) agreements. While we strive to execute all integrations, migrations, and setups with maximum care, you acknowledge that CRM interfaces, APIs, and hosting providers are subject to third-party outages, rate limits, schema deprecations, or sudden updates. We are not liable for alterations made to operational systems by third-party vendor platforms.

By using the site, you represent and warrant that: • All registration or inquiry information you submit will be true, accurate, current, and complete. • You will maintain the accuracy of such information and promptly update such registration information as necessary. • You have the legal capacity and you agree to comply with these Terms of Service. • You are not a minor in the jurisdiction in which you reside. • You will not access the site through automated or non-human means, whether through a bot, script, or otherwise. • You will not use the site for any illegal or unauthorized purpose, and your use of the site will not violate any applicable law or regulation.

You may not access or use the site for any purpose other than that for which we make the site available. The site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. In no event will Migosys, or our directors, employees, or agents, be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or our services, even if we have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us during the six (6) month period prior to any cause of action arising.

We reserve the right to change, modify, or remove the contents of the site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our site. We also reserve the right to modify or discontinue all or part of the site without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the site.

These Terms of Service and your use of the site are governed by and construed in accordance with the laws applicable to agreements entered into and to be entirely performed within our operating state/country, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms will be brought exclusively in courts of competent jurisdiction.
